The Tennessee Supreme Court has refused to hear the appeal of a Warren County man facing 153 years in prison for the rape of a child.
The court ruled Friday it would not hear the case of John David Smartt, convicted on 12 counts involving sexual relations with a child beginning at the age of four.
Smartt sentenced in April 2016 following a second trial on five counts of rape of a child, one count of rape, three counts of especially aggravated sexual exploitation of a child, and three counts of aggravated sexual exploitation of a child. The first jury trial ended in a mistrial.
A circuit court appeal in 2017 affirmed the judgments of the trial court.
